Training Services Agreement
This agreement is made and entered between Paws Mindfully (hereinafter ‘Trainer’) and Client and dog (Name/details as stated in Information and Consent form), both referred to as separately as Party and together as Parties. On the basis of mutual understanding and due consideration, the Parties agree to the following:
1. General Provisions
The purpose of this agreement is provision of the services described herein pertaining to the Client’s dog:
The Trainer agrees to provide the services in a thorough and professional manner, while the Client agrees to act in accordance with the instructions provided by the Trainer and to pay the fee for the services provided by the Trainer.
2. Payment / Cancellation Policy
All payments of packages or follow up sessions must be made in full or be on a payment plan prior to the first initial consultation/session.
Initial Consultation Cancellation/Rescheduling Policy: Paws Mindfully requires 24 hours’ notice to reschedule an initial consultation appointment. Initial consultations may be rescheduled twice whereas after a $20 rescheduling fee will apply.
Cancellation/Rescheduling Policy: Paws Mindfully requires 24-hour notice to reschedule a training appointment. Cancellations made with less than 24 hours’ notice will forfeit that appointment unless there are mitigating circumstances and within the discretion of the trainer. Training appointments may be rescheduled once.
Packages must be used/completed within a designated time frame as stated below:
– Calm Canine Basic to be used/completed within 3 months of initial consultation.
– Calm Canine Advanced to be used/completed within 6 months of initial consultation.
– Dog Aromatherapy Package to be used/completed within 2 months of initial consultation.
*All training packages are valid for 12 months from date of purchase.
Any sessions not completed by the deadline are forfeit, non-refundable and non-transferrable.
No refunds are given for completed sessions.
Training Follow-up Sessions
Payment Policy: The training sessions (either 1, 3 or 5) must be made in full or be on a payment plan prior to the first session.
Training sessions are non-refundable and must be used within the specified timeframe* (6 weeks for 3x sessions, and 10 weeks for 5x sessions, *unless otherwise arranged with Paws Mindfully at the time of booking).

3. Services
Trainer agrees to provide private / group sessions for Dog and Client (hereinafter ‘Package’).
The Package consists of an initial consultation and a number of sessions, each session lasting for up to 60 minutes. The initial consultation will take place via zoom or phone call. If package is face to face sessions will either take place at a Client’s home or other appropriate place prior in agreement between Trainer and Client.
The client must complete the Package within the allocated time – see Payment/Cancellation policy for details.
The purpose of the training is to adjust the behaviour of the Dog and to teach the Client how to train and work with the Dog. Client hereby agrees that no training is perfect and that effects of the training can be affected by various factors. The client understands that no guarantee or assurance can be made as to the results that may be obtained from the training sessions.
Trainer will take all appropriate measures to achieve training and behaviour goals only using force free, reward-based methods and tools. Client further agrees to take all necessary steps to assist the Trainer and to follow up on any instructions or recommendations provided by the Trainer, especially to work with the Dog daily and to consistently reinforce the training provided.
Client further accepts that the Dog may be exposed to a variety of environmental conditions which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to areas with crowds and all types of traffic.
Trainer will recommend the Client on the equipment that is necessary for them to acquire. Client agrees to use the equipment in accordance with the instructions provided by the trainer.
The Trainer will not support any use of tools or methods that can cause psychological or physical damage to the Dog. This includes but is not limited to: using shock/electric and prong collars, choke/check, bark or citronella collars, slip leads, spraying water or other fluids to stop a behaviour. As well as scolding or yanking on the leash, pinching or smacking or any other form of physical punishment, verbal punishments such as yelling and asserting dominance. The Trainer reserves the right to end the contract if the Client uses or continues to use any the above methods or tools.
4. Liability
Trainer is not liable for any damages or injuries caused by a Dog, during or after the term of this agreement. The Client agrees to pay for all resulting losses or damages and compensate the Trainer, Trainer’s agents, employees and affiliates, from any resulting claims, lawsuits, costs and expenses, including legal fees. If during or after the term this agreement the Dog is injured or harmed, the Client assumes the risk and agrees the Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.
Trainer is not liable for any damage or injury caused by the equipment during or after the training. Client is responsible for any destruction or damage of the equipment provided by Trainer in all cases where such damage cannot be credited to equipment’s regular wear and tear.
5. Terms of the Agreement
This agreement is valid for the duration of the Package and any further training booked thereafter with Paws Mindfully. This agreement may be terminated in the sole discretion of the Trainer if the Dog is aggressive, dangerous, or otherwise deemed unsuitable for training, or if the Client breaches any part of this agreement.
Final Provisions
In case of any dispute the Parties agree to mediate and settle through negotiations and mutual understanding.
This Training Services Agreement supersedes all other agreements, written or oral, previously made between Client and Trainer.
